Privacy Policy

This personal data processing policy is drafted in accordance with the requirements of Federal Law No. 152-FZ dated July 27, 2006, "On Personal Data" (hereinafter — the Law on Personal Data) and defines the procedures for processing personal data and measures to ensure the security of personal data undertaken by Krasovitsky Alexander Evgenievich (hereinafter — the Operator).

1.1. The Operator considers the observance of human and citizen rights and freedoms during the processing of personal data, including the protection of the right to privacy, personal, and family secrets, as its primary goal and condition for the activity.

1.2. This Policy of the Operator regarding the processing of personal data (hereinafter — the Policy) applies to all information that the Operator may receive about visitors to the website https://fliker-art.ru/.

2.1. Automated processing of personal data — processing of personal data using information technology tools.

2.2. Blocking of personal data — temporary cessation of processing personal data (except when processing is necessary for clarifying personal data).

2.3. Website — a collection of graphic and informational materials, as well as computer programs and databases, ensuring their accessibility on the internet at the network address https://fliker-art.ru/.

2.4. Personal data information system — a set of personal data contained in databases and the information technologies and technical means ensuring their processing.

2.5. Anonymization of personal data — actions resulting in the inability to identify a specific user or other data subject without using additional information.

2.6. Processing of personal data — any action (operation) or set of actions (operations) performed with personal data using automation tools or without them, including collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (dissemination, provision, access), anonymization, blocking, deletion, destruction of personal data.

2.7. Operator — a state body, municipal body, legal or natural person organizing and/or carrying out the processing of personal data, as well as determining the purposes of processing, the composition of personal data subject to processing, and the actions (operations) performed with personal data.

2.8. Personal data — any information directly or indirectly related to a specific or identifiable user of the website https://fliker-art.ru/.

2.9. Personal data permitted for dissemination — personal data access to an unlimited circle of persons provided by the data subject through consent to processing, permitted for dissemination in accordance with the Law on Personal Data (hereinafter — permitted personal data).

2.10. User — any visitor of the website https://fliker-art.ru/.

2.11. Providing personal data — actions aimed at disclosing personal data to a specific person or a specific circle of persons.

2.12. Dissemination of personal data — any actions aimed at disclosing personal data to an undefined circle of persons (transfer of personal data) or familiarizing an unlimited circle of persons with personal data, including publication in mass media, posting on information and telecommunication networks, or granting access to personal data in any other way.

2.13. Cross-border transfer of personal data — transfer of personal data to the territory of a foreign state to a foreign authority, a foreign individual, or a foreign legal entity.

2.14. Destruction of personal data — any actions resulting in the irreversible destruction of personal data, making it impossible to restore the contents of personal data in the personal data information system, and/or destroying physical carriers of personal data.

3.1. The Operator has the right to:

— receive accurate information and/or documents containing personal data from the data subject;
— continue processing personal data without the data subject’s consent in cases where the data subject withdraws consent or submits a request to cease processing, provided there are grounds specified in the Law on Personal Data;
— independently determine the scope and list of measures necessary and sufficient to ensure the fulfillment of obligations stipulated by the Law on Personal Data and adopted in accordance with it, unless otherwise provided by the Law on Personal Data or other federal laws.

3.2. The Operator is obliged to:

— provide the data subject with information regarding the processing of their personal data upon request;
— organize the processing of personal data in accordance with the applicable legislation of the Russian Federation;
— respond to requests and inquiries from data subjects and their lawful representatives in accordance with the requirements of the Law on Personal Data;
— inform the authorized body for the protection of the rights of data subjects upon request of this body within 10 days from the date of receipt of such request;
— publish or otherwise ensure unrestricted access to this Policy regarding personal data processing;
— implement legal, organizational, and technical measures to protect personal data from unlawful or accidental access, destruction, alteration, blocking, copying, dissemination, or other unlawful actions;
— cease the transfer (dissemination, provision, access) of personal data, stop processing, and destroy personal data in the manner and cases provided by the Law on Personal Data;
— fulfill other obligations stipulated by the Law on Personal Data.

4.1. Data subjects have the right to:

— receive information regarding the processing of their personal data, except in cases provided by federal laws. The information is provided by the Operator in an accessible form and must not contain personal data related to other data subjects unless there are lawful grounds for such disclosure. The list of information and the procedure for obtaining it are established by the Law on Personal Data;
— request the Operator to clarify, block, or destroy their personal data if it is incomplete, outdated, inaccurate, unlawfully obtained, or not necessary for the declared processing purpose, and to take legally provided measures to protect their rights;
— impose a condition of prior consent for processing personal data for the purpose of marketing goods, works, and services;
— withdraw consent to the processing of personal data and send a request to cease processing;
— appeal to the authorized body for the protection of the rights of data subjects or to the court regarding unlawful actions or inaction of the Operator in processing their personal data;
— exercise other rights provided by the legislation of the Russian Federation.

4.2. Data subjects are obliged to:

— provide the Operator with accurate data about themselves;
— inform the Operator about clarifications (updates, changes) to their personal data.

4.3. Persons who have provided the Operator with false information about themselves or information about another data subject without their consent bear responsibility in accordance with the legislation of the Russian Federation.

5.1. The processing of personal data is carried out on a lawful and fair basis.

5.2. The processing of personal data is limited to achieving specific, predetermined, and lawful goals. Processing that is incompatible with the purposes of data collection is not permitted.

5.3. It is prohibited to combine databases containing personal data if their processing purposes are incompatible.

5.4. Only personal data that corresponds to the purposes of processing are subject to processing.

5.5. The content and volume of processed personal data must match the declared processing goals. Excessive processing of personal data beyond the stated purposes is not allowed.

5.6. During processing, the accuracy, sufficiency, and, if necessary, the relevance of personal data in relation to the processing goals are ensured. The Operator takes necessary measures and/or ensures their adoption to delete or clarify incomplete or inaccurate data.

5.7. Personal data is stored in a form that allows identifying the data subject, no longer than required by the processing goals, unless a longer period is established by federal law, a contract, or the party involved, the beneficiary, or the guarantor of the contract, is the data subject. Processed personal data are destroyed or anonymized upon achieving the processing goals or if there is no longer a need for these purposes, unless otherwise provided by federal law.

6.1. Purposes of processing:

• informing the User through sending emails;
• clarifying order details.

6.2. Personal data:

• surname, first name, patronymic;
• email address;
• phone numbers.

6.3. Legal grounds — the statutory (founding) documents of the Operator.

6.4. Types of personal data processing:

• collection, recording, systematization, accumulation, storage, destruction, and anonymization of personal data;
• sending informational emails to the email address.

7.1. Processing of personal data is carried out with the consent of the data subject for the processing of their personal data.

7.2. Processing of personal data is necessary to achieve the purposes provided for by an international treaty of the Russian Federation or by law, and to carry out the functions, powers, and duties assigned to the operator by the legislation of the Russian Federation.

7.3. Processing of personal data is necessary for the administration of justice, execution of a court order, or an act of another body or official, to be executed in accordance with the legislation of the Russian Federation on enforcement proceedings.

7.4. Processing of personal data is necessary for the execution of a contract, the party of which is the data subject or the beneficiary or guarantor of which is the data subject, as well as for concluding a contract at the initiative of the data subject or a contract in which the data subject will be the beneficiary or guarantor.

7.5. Processing of personal data is necessary to exercise the rights and legitimate interests of the operator or third parties, or to achieve socially significant goals, provided that the rights and freedoms of the data subject are not violated.

7.6. Processing of personal data is carried out when access to such data is granted to an unlimited circle of persons by the data subject or upon their request (hereinafter — publicly available personal data).

7.7. Processing of personal data that is subject to publication or mandatory disclosure in accordance with federal law is carried out.

Personal data security, which is processed by the Operator, is ensured through the implementation of legal, organizational, and technical measures necessary to fully comply with the current legislation in the field of personal data protection.

8.1. The Operator ensures the safety of personal data and takes all possible measures to prevent unauthorized access to personal data.

8.2. Personal data of the User will never be transferred to third parties under any circumstances, except in cases related to the implementation of applicable legislation or if the data subject has given consent to the Operator to transfer data to a third party for the fulfillment of obligations under a civil law contract.

8.3. If inaccuracies are identified in personal data, the User can update them independently by sending a notification to the Operator’s email Fliker.Devices@yandex.ru with the note "Updating Personal Data."

8.4. The term for processing personal data is determined by the achievement of the purposes for which the data was collected, unless another term is stipulated by a contract or applicable legislation.
The User can revoke their consent to the processing of personal data at any time by sending a notification to the Operator via email to Fliker.Devices@yandex.ru with the note "Revoking Consent for Personal Data Processing."

8.5. All information collected by third-party services, including payment systems, communication tools, and other service providers, is stored and processed by these entities in accordance with their User agreements and Privacy Policies.The data subject and/or the relevant documents are not responsible for actions taken by third parties, including the providers mentioned in this clause.

8.6. The restrictions set by the data subject on transferring (except for providing access) or processing personal data, as well as conditions for processing (except for access), do not apply in cases of processing personal data for state, public, or other legally defined interests in accordance with Russian legislation.

8.7. When processing personal data, the Operator ensures the confidentiality of personal data.

8.8. The Operator stores personal data in a form that allows identifying the data subject no longer than necessary to achieve the processing goals, unless a longer period is established by federal law, a contract, or the party involved, the beneficiary, or the guarantor of the contract.

8.9. The grounds for terminating the processing of personal data include the achievement of the processing goals, expiration of the data subject’s consent, revocation of consent by the data subject, or a request to cease processing personal data, as well as the detection of unlawful processing of personal data.

9.1. The Operator carries out collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (dissemination, provision, access), anonymization, blocking, deletion, and destruction of personal data.

9.2. The Operator performs automated processing of personal data, including receiving and/or transmitting the obtained information via information and telecommunication networks or without them.

10.1. Before commencing activities related to cross-border transfer of personal data, the Operator is obliged to notify the authorized body for the protection of the rights of data subjects about its intention to carry out such transfer (this notification is sent separately from the notification of the intention to process personal data).

10.2. Prior to submitting the above notification, the Operator must obtain relevant information from the authorities of the foreign state, foreign individuals, or foreign legal entities to whom the cross-border transfer of personal data is planned.

The Operator and other persons who have access to personal data are obliged not to disclose or disseminate personal data to third parties without the consent of the data subject, unless otherwise provided by federal law.

12.2. Any changes to the personal data processing policy by the Operator will be reflected in this document. The policy is valid indefinitely until replaced by a new version.
